Alleghany County July Circuit Court Cases

Alleghany County Circuit Court cases were heard in July before Judge Malfourd W. Trumbo. Prosecution was handled by Ed Stein, commonwealth’s attorney for Alleghany County and Covington.

July 13 Hearing
William Knighton Burns, Buena Vista, pled guilty to driving while intoxicated:first offense.

The offense date was July 15, 2011.

Burns was sentenced to 60 days in jail, suspended, and fined $250. He was assessed $200 costs and placed on unsupervised probation for one year. Burns’ driver’s license was suspended for 12 months. The court approved the issuance of a restricted driver’s license that will expire June 12, 2013.

July 16 Hearings

Clyde Thomas Hubbard, Chambersburg, Pa., was sentenced on charges of felony hit and run and attempting to elude police.

The offense date was June 17, 2011.

Hubbard was found guilty of the offenses Feb. 23, 2012.

Sentencing was deferred until a pre-sentencing report was filed by a probation officer.

Hubbard was sentenced to 10 years in prison, with eight years suspended. He was assessed $840 costs. Hubbard will be placed on three years supervised probation after being released from custody. His driver’s license was suspended for three months.

Randy Elmore, Covington, pled guilty to destruction of property.

The offense date was Oct. 30, 2011. Elmore was originally charged with torturing an animal, causing death.

He was sentenced to 12 months in jail, suspended, and assessed $247 costs. Elmore was placed on unsupervised probation for one year.

Scott Frazier Tucker, Covington, pled guilty to assault and battery.

The offense date was Sept. 16, 2011. Frazier was originally charged with malicious wounding.

He was sentenced to 12 months in jail, suspended, and assessed $247 costs. Frazier was placed on unsupervised probation for one year.

Kameron Alan Broughman, Clifton Forge, pled guilty to grand larceny and breaking and entering.

The offense date was Nov. 10, 2011.

The court took the cases under advisement and ordered Broughman to pay $8,400 restitution.

Victor Wayne Persinger, Clifton Forge, pled guilty to possession of marijuana and possession of a Schedule I or II drug.

The offense date was Nov. 23, 2011. Persinger was originally charged with selling, distributing marijuana and selling or providing for the resale f a Schedule I or II drug.

He was sentenced to three years in prison and 30 days in jail, suspended, and assessed $886.50 costs. Persinger was placed on three years supervised probation. His driver’s license was suspended for six months. The court approved a restricted license that will expire Jan. 15, 2013.

Naomi Ruth Morgan, Covington, pled guilty to possession of a Schedule I or II drug and two counts of distributing a Schedule VI drug.

The offense dates were Nov. 16, 2011; Nov. 18, 2011; and Dec. 31, 2011.

On the conviction for possession of a Schedule I or II drug, Morgan was sentenced to two years in prison, suspended, and assessed $2,069.50 costs. She was placed on supervised probation for three years and ordered to pay $400 restitution. Morgan’s driver’s license was suspended for six months.

For the distribution of a Schedule VI drug convictions, she was sentenced to a total of 12 months in jail, suspended, and placed on three years supervised probation.

Aaron Jacob Samuel Hanshew, Hot Springs, pled guilty to larceny-third offense and driving while intoxicated-second offense.

The offense date was Jan. 25, 2012.

Hanshew was sentenced to two years in prison on the larceny conviction, with one year, 11 months, suspended – leaving one month to serve. He was sentenced to 90 days in jail on the DWI conviction, with 60 days suspended. Hanshew was fined $500 and $1,158 costs. He was placed on three years unsupervised probation for DWI conviction and his driver’s license was suspended for 12 months. Following release from custody, Hanshew will be placed on supervised probation for two years for the larceny conviction.

Edward McElwee Loan III, Covington, pled guilty to firearm larceny not from the person of another, entering a house with intent to commit larceny, assault and battery or another felony, and possession of a gun within 10 years after being convicted of a felony.

The offense date was April 19, 2012.

Loan was sentenced to 15 years in prison with 10 years suspended. He will be placed on three years supervised probation following release from custody. The court assessed $1,435 costs.

Stephen Christopher Cale, Selma, pled guilty to embezzlement involving $200 or more.

The offense date was Oct. 3, 2011.

Cale was sentenced to two years in prison, suspended, and assessed $540 costs. He was placed on three years supervised probation and ordered to pay $8,855 restitution.

John William Spinner III, Clifton Forge, pled guilty to carrying a concealed weapon and assault and battery.
The offense date was Dec. 23, 2011.

Spinner was sentenced to 12 months in jail, with 11 months suspended. He was assessed $673 costs and will be placed on unsupervised probation for one year following release from custody.

John Robert Broy Jr., Covington, pled guilty to grand larceny, breaking and entering (two counts) and grand larceny involving $200 or more,

The offense dates were Dec. 8, 2011, and Dec. 16, 2011.

Broy was sentenced to 10 years in prison, with eight years suspended. Upon release, Broy will be placed on three years supervised probation. He was assessed $1,725 costs and ordered to pay $10,000 restitution.

Sandra Tucker Nichols, Covington, pled guilty to larceny involving a bad check totaling less than $200.

The offense date was Dec. 20, 2011.

Nichols was sentenced to 30 days in jail, suspended, and assessed $247 costs.

She was placed on unsupervised probation for one year.

Laura Dee Wright, Covington, pled guilty to possession of a Schedule II drug.

The offense date was Sept. 2, 2011.

Wright was sentenced to five years in prison, with four years suspended. Upon release, she will be placed on three years supervised probation. The court assessed $570 costs and ordered Wright to pay $250 restitution. Her driver’s license was suspended for six months.

July 17 Hearings

Amber Renee Nicely, Covington, pled guilty to possession of a Schedule II drug with intent to distribute.

The offense date was Feb. 12, 2011.

She was sentenced to five years in prison, suspended, and assessed $1,780 costs. Nicely was placed on three years supervised probation. Her driver’s license was suspended for six months. Nicely was ordered to pay $276 restitution.

Amanda Simmons Propps was tried on four charges of obtaining a prescription by fraud.

The alleged offenses occurred Sept. 17, 2011; Sept. 25, 2011; Oct. 5, 2011; Oct. 6, 2011.

Propps pled not guilty.

The court took the cases under advisement and placed Propps on supervised probation for two years. Her driver’s license was suspended for six months.

July 25 Hearings

Daniel Wayne Potter, Clifton Forge, pled guilty to breaking and entering (three counts), grand larceny, grand larceny involving $200 or more not from the person of another, grand larceny involving $200 or more (two counts), conspiring to commit breaking and entering and stealing property from a person.

The offense dates were Dec. 8, 2011; Dec. 14, 2011; Dec. 16, 2011; and April 23, 2012.

Potter was sentenced to 13 years in prison, suspended, and placed on four years supervised probation under the diversion center incarceration program. He was assessed $4,265 costs and ordered to pay $15,000 restitution.

Katrina Valia Heighter, Covington, was found guilty of contempt of court.

The offense date was April 9, 2012.

Heighter was sentenced to 10 days in jail.

Missy Pritt, Covington, pled guilty to possession of a Schedule II drug with intent to distribute.

The offense date was Nov. 22, 2011.

Pritt was sentenced to five years in prison, suspended, and placed on three years supervised probation. Her driver’s license was suspended for six months and she was assessed $985 costs. The court ordered Pritt to pay $350 restitution.

Davis Stanford Howard, Hot Springs, pled guilty to credit card fraud involving less than $200 and two counts of felony larceny.

The offenses dates were Oct. 29, 2011; Jan. 5, 2012; and Jan. 7, 2012.

Howard was sentenced to four years confinement, with three and one-half years suspended, leaving six months to serve.

He was assessed $2,448 costs and ordered to pay $124 restitution. Following release from custody, Howard will be placed on supervised probation for three years.

Ray W. Keen Jr., Covington, pled guilty to trespassing to hunt/fish/trap.

The offense date was Dec. 6, 2011. Keen had appealed the case from Alleghany County General District Court. He was originally charged with trespassing on posted property to hunt.

Keen was fined $200 and $161 costs.

July 30 Hearings

Michael Travis Harth, Troutville, pled guilty to possession of marijuana.

The offense date was Aug. 31, 2011.

He was sentenced to 90 days in jail, suspended, and placed on unsupervised probation for one year. The court assessed $316.50 costs and suspended Harth’s driver’s license for six months.

Jesse Cain Pero, Roanoke, pled guilty to possession of a Schedule I drug.

The offense date was Aug. 31, 2011.

The court deferred disposition of the case and assessed Pero $990 costs. He was placed on supervised probation for two years. His driver’s license was suspended for six months.

David G. Miller, Covington, pled guilty to larceny involving a bad check in the amount of $200 or more.

The offense date was July 27, 2011.

He was sentenced to two years in prison, suspended, and assessed $865 costs. The court placed Miller on unsupervised probation for two years and ordered him to pay $3,700 restitution.

Thomas Michael Tamanini, Staunton, pled guilty to five counts of possession of child pornography (second-plus offense).

The offense date was Dec. 8, 2010.

Tamanini was sentenced to 15 years in prison, with 12 years suspended. He was assessed $2,902.50 costs. Following release from custody, he will be placed on five years supervised probation.

Aaron James Wickline, Wirtz, pled guilty to accessory after the fact in a felony.

The offense date was Oct. 16, 2011.

He was sentenced to 12 months in jail, suspended, and assessed $235 costs.

Joshua Neal Phillips, Covington, pled guilty to possession of a Schedule II drug with intent to distribute (six counts).

The offense date was March 20, 2012; April 2, 2012; April 19, 2012.

Phillips was sentenced to 30 years in prison, suspended, and placed on supervised probation for four years. He was assessed $3,835 costs and ordered to pay $800 restitution.

The court suspended Phillips’ driver’s license for six months.
