February Cases Heard In Alleghany County Circuit Court

Cases heard in February before Judge Malfourd W. Trumbo in Alleghany County Circuit Court. Ed Stein, commonwealth’s attorney for Alleghany County and Covington, prosecuted.

Feb. 1 Hearing
Megan A. Bennett, Covington, pled guilty to providing a prisoner with a cell phone.

The offense date was July 27, 2011.

Bennett was sentenced to two years in prison, suspended, and placed on two years supervised probation. She was assessed $420 costs.

Troy Dean Hall, Marlington, W.Va., pled guilty to three counts of grand larceny.

The offense date was July 20, 2011.

Hall was sentenced to three years in jail with two years, 10 months suspended-leaving two months to serve. Following release from custody, he will be placed on unsupervised probation for three years. Hall was ordered to pay $1,510 restitution. He was assessed $766 costs.

Michelle D. Tingler of Covington was sentenced on a charge of welfare fraud.

The offense date was Nov. 7, 2007. Hall entered a guilty plea Aug. 17, 2009.

She was sentenced to two years in prison, suspended, and placed on two years probation. Tingler was ordered to pay $3,865 restitution. She was assessed $889.74 costs.

Jason W. Copenhaver II of White Sulphur Springs, W.Va., pled guilty to petit larceny and entering property to commit damage.

The offense date was July 20, 2011.

He was sentenced to 12 months in jail, suspended, and placed on unsupervised probation for one year. Copenhaver was ordered to pay $700 restitution and assessed $878 costs.

Patricia Fridley Shrewsbury, Covington, pled guilty to embezzling less than $200.

The offense date was Aug. 22, 2011.

She was sentenced to 12 months in jail, suspended, and placed on unsupervised probation for one year. Shrewsbury was ordered to pay $420 restitution and assessed $872.69 costs.

Feb. 15 Hearings
Nicholas Jeremiah Raether, Clifton Forge, entered an Alford plea to two counts of accommodating the distribution of a Schedule III drug.

The offense date was Aug. 26, 2010.

He was sentenced to 12 months in jail, suspended, and placed on unsupervised probation for one year. Raether was assessed $633 costs and his driver’s license was suspended for six months. The court approved the issuance of a restricted driver’s license that will expire Aug. 14, 2012.

Pamela N. Wilcher, Covington, pled guilty to bad check (larceny) involving more than $200.

The offense date was Nov. 10. 2010.

She was sentenced to two years in prison, suspended, and placed on supervised probation for one year. Wilcher was ordered to pay $637.43 restitution and assessed $440 costs.

Edward McElwee Loan III, Covington, pled guilty to entering a house to commit larceny, and grand larceny.

The offense date was Oct. 6, 2011.

He was sentenced to 2 1/2 years in prison, suspended, and placed on four years supervised probation. Loan was ordered to pay $385 restitution and assessed $3,025 costs.

Samantha Leigh Depriest, Covington, pled guilty to shoplifting/altering merchandise valued at less than $200 and failure to appear on a felony charge.

The offense dates were Oct. 25, 2011, and Nov. 10, 2011.

She was sentenced to nine months in jail, with six months, 20 days suspended. Following release from custody, she will be placed on unsupervised probation for one year Depriest was ordered to pay $77.30 restitution and assessed $707.16 costs.

Lloyd Edward Moore, Clifton Forge, pled guilty to driving while intoxicated (third offense) and driving while license revoked.

The offense date was Oct. 29, 2011.

Moore was sentenced to five years in prison, with three years suspended. Following release from custody, he will be placed on three years supervised probation. Moore’s driver’s license was suspended indefinitely by the court.

He was assessed $1,800.24 costs.

Edward McElwee Loan III, Covington, pled guilty to possession of a Schedule II drug with intent to distribute, entering a structure to commit larceny, and petit larceny.

The offense dates were April 12, 2011, and Sept. 1, 2011.

On the drug charge and charge of entering a structure to commit larceny, he was sentenced to six years, six months in prison, suspended. On the petit larceny charge, he was sentenced to 12 months in jail, suspended. Loan was placed on four years supervised probation. He was ordered to pay $385 restitution.

Kathy Lorraine Nelson, Covington, was sentenced on a charge grand larceny.

The offense date was April 23, 2011.

Nelson entered a guilty plea of Oct. 4, 2011, with sentencing deferred by the court.

She was sentenced to eight years in prison, with six years suspended. Nelson was fined $1,000 and assessed $2,985.94 costs. Following release from custody, she will be placed on unsupervised probation for one year.

Matthew A. Ray, Roanoke, pled guilty to failing to register as a sex offender (second offense).

The offense date was June 23, 2011.

He was sentenced to five years in prison, with four years suspended. He will be placed on three years supervised probation following release from custody. Ray was assessed $860 costs.

William James Lamb., Clifton Forge, pled guilty to possession of a controlled substance.

The offense date was Sept. 10, 2011.

He was sentenced to two years in prison, suspended, and placed on two years supervised probation. He was assessed $1,105 costs. Lamb’s driver’s license was suspended for six months.

Kathy Lorraine Nelson, Covington, pled guilty to felony larceny and driving under the influence (subsequent offense).

The offense date was Oct. 10, 2011.

She was sentenced to six years in prison, with two years, nine months suspended. Nelson will be placed on supervised probation for three years following release from custody.

Her driver’s license was suspended indefinitely by the court.

Harry Paul NIckell, Covington, pled guilty to driving under the influence (first offense).

The offense date was Sept. 29, 2011.

Nickell was sentenced to 60 days in jail, with 56 days suspended. He was placed on unsupervised probation for one year. Nickell was fined $250 and $225 costs. His driver’s license was suspended by the court for one year. The court approved a restricted license that will expire Feb. 16, 2013.

Feb. 17 Hearings
Stacy Edith Miller, Staunton, pled guilty to speeding, 87 mph in a 70 zone.

The offense date was Aug. 22, 2011. Miller had appealed the case from Alleghany County General District Court.

She was fined $200 and $161 costs.

Katrina Lynn Shahan, Covington, pled guilty to driving without a license.

The offense date was May 26, 2011. She had appealed the case from General District Court.

She was sentenced to six months in jail, with five months suspended. Shahan was fined $100 and $477.78 costs. Her driver’s license was suspended for 90 days.

Chester Lynn Wickline of Wirtz was sentenced on a charge of issue a threat over the telephone.

The offense date was Nov. 11, 2011. Wickline had appealed the case from District Court. The appeal was withdrawn.

He was sentenced to four months in jail, with three months suspended. Wickline was fined $250 and $474.25 costs.

Melanie L. Kozak. Jefferson, Md., pled guilty to speeding, 79 mph in a 70 zone.

The offense date May 18, 2011. Kozak had appealed the case from District Court. She was originally charged with speeding, 86 mph in a 70 zone.

Kozak was fined $150 and $161 costs.

Howard Arnold Nicely, Clifton Forge, pled guilty to violating probation.

The offense date was Nov. 2, 2011.

The court revoked NIcely’s probation and sentenced him to 6 months in jail. He was assessed $122 costs.

Feb. 23 Hearings
Bradley Shane Tingler, Millboro, pled guilty to six counts of grand larceny.

The offense dates were June 3, 2011; June 15, 2011; June 14, 2011; June 20, 2011; July 1, 2011; Dec. 14, 2011.

He was sentenced to six years in prison, suspended, and placed on supervised probation for four years. Tingler was ordered to pay $5,000 restitution and assessed $2,400 costs.

Tingler also pled guilty to four counts of petit larceny.

The offense dates were June 19, 2011; June 20, 2011; June 25, 2011.

He was sentenced to two years in jail, suspended.

Feb. 29 Hearings
James Bernard Pritt III, Clifton Forge, pled guilty to three counts of possessing one-half ounce to five pounds of marijuana with intent to distribute.

The offense dates were June 6, 2010; June 7, 2010; and June 28, 2010.

Pritt was sentenced to six years in prison, with five years suspended. Following release from custody, he will be placed on three years supervised probation. Pritt was assessed $2,481.50 costs. His driver’s license was suspended for six months.

Jermaine Lataize Winston, Clifton Forge, pled guilty to two counts of selling/providing for the resale of a Schedule I or II drug.

The offense dates were June 3, 2010; and July 1, 2010.

Winston was sentenced to 10 years in prison, with nine years suspended. Following release from custody, he will be placed on three years supervised probation. He was assessed $1,140 costs. His driver’s license was suspended for six months.

Jeff Allen Adkins of Ansted, W.Va., pled guilty to grand larceny.

The offense occurred May 25, 2011.

Adkins was sentenced to 12 months in jail and assessed $420 costs.

Christopher M. Simmerman, Clifton Forge, pled guilty to possession of a firearm by a convicted felon and grand larceny. The offense date was June 1, 2011.

Simmerman was sentenced to five years in prison, with three years suspended. He will be placed on three years supervised probation following release from custody.

Simmerman was assessed $1,501.34 court costs.

Dakota Chase Anderson, Clifton Forge, pled guilty to failing to return rental property valued at more than $200 and contempt of court for failing to appear.

The dates of the offenses were June 9, 2011, and Jan. 26, 2012.

Anderson was sentenced to 13 months in jail, with 12 months suspended. He was placed on supervised probation for one year and assessed $1,128 costs. The court ordered Anderson to pay $300 restitution.

Eugene Mark Decaprio, Woodbridge, was found guilty of driving under the influence.

The offense date was Sept. 18, 2011. Decaprio had appealed the case from General District Court. The appeal was withdrawn.

He was sentenced to 60 days in jail, suspended, and fined $250 with $261 costs. Decaprio’s driver’s license was suspended for one year. The court approved a restricted driver’s license that will expire Feb. 27, 2013.

William Terrell Thomas Givens, Clifton Forge, pled guilty to possession of marijuana, possession of a controlled substance, driving under the influence and contempt for failing to appear.

The offense dates were June 16, 2007; and July 8, 2008.

Givens was sentenced two years in prison, suspended, on the possession of a controlled substance charge. He was fined $250 and $2,252.50 costs. He was ordered by the court to pay $400 restitution. On the marijuana and DUI charges, Givens was sentenced to 90 days in jail, suspended. Givens was credited with time served on the contempt of court charge. He was placed on three years supervised probation.

Givens’ driver’s license was suspended for six months.
