September 18, 1931: State Charges Premeditated Murder To Him
Bond for the release from jail of Elisha Kent Kane, university of Tennessee Professor charged with the drowning of his wife, was fixed at $16,000 today by Judge Spratley in the Circuit Court here.
It was not immediately available, but defense attorneys said a bond from a securities company would be presented tomorrow at 9 o’clock.
Immediately afterward, Judge Spratley set September 23, as the date for the preliminary hearing in the case.
Percy Carnell, defense attorney, said the hearing would not be waived. Captain Roland Cocke, Commonwealth Attorney, asked that bail bond be not less than $100,000.
Frank Kearney, Assistant Commonwealth’s Attorney, said the State’s contention was that the drowning of Mrs. Kane in Chesapeake Bay was a premeditated murder for which her husband was responsible, making the killing a capital case “in which there is no middle court.”
