Alleghany County proposes to amend its code section that covers encroachments or obstructions on county property without a permit.
Alleghany County administration and the director of parks and recreation are exceeding their positions by inferring that they can ignore easements to property on the sides of the Jackson River Scenic Trail.
When the Hot Springs branch of the C&O Railroad was established and operational, property owners had recognized legal easements through and across the railroad.
This is acknowledged in the one true survey document on record with the CSX Real Properties Inc. GIS Department. The survey map document contains all of the acknowledgement easements that the railroad recognized when they bought and sold the property.
Jack D. Showalter ET. Ux. also acknowledged the rights to the easements and crossings when he purchased and operated his scenic railroad.
The county government does not have the rights to condemn or ignore these easements. They must follow the same laws that all of us need to observe when it come to easements and property use.
